There exists a draft RFC that points out the obvious:

Everyone has an acceptable use policy.
Your basis for AUP comes from your suppliers/providers.
You might want to add your own twists.
You had better tell you clients/customers what your AUP is, up front.

The questions of redress in the event of violation are left up to
the creator of the specific AUP.

This model holds true at every level of the net.  IF you don't take these
simple steps, you deserve the entanglements you will get into.
