Since it is the Internet provider (ISP) who is adversely affected by a user
posting inappropriately (see what happens if your system suddenly gets 10x
or 100x incoming mail one day because one of your users posted a get rich
scheme to 5000 newsgroups), the ISP is the most logical responsible party.
Imagine an extreme situation: A certain ISP is suddenly "home" to a few
thousand people who ALL are constantly posting inappropriately. Now, not
only would the ISP's system performance be affected, but the ISP might find
sites around the world blocking ALL traffic from that site.
So, I maintain that it is the ISP that is responsible to the net at large,
and must therefore take the responsibility of taking reasonable steps that
their users understand what is proper behavior.
