This is our statement that students must sign off on before we touch their =
computers, whether in our drop-off center or in the user's room or apartmen=
t.
"I authorize the Montana State University ResNet Technician(s) to perform w=
ork on my computer. I understand that MSU ResNet technicians have been tra=
ined to perform computer hardware and software work, but MSU ResNet is not =
an authorized service dealer. Further, I agree to release, indemnify, and =
hold harmless MSU and its employees from liability for any claims or damage=
s of any kind or description that may arise from any computer work performe=
d on my computer, even if caused by negligence of MSU ResNet or its agent. =
I understand that MSU ResNet is not responsible for any data loss which ma=
y occur as a result of work done on my computer."
We've never been sued or pursued for damages in any case. If it was a case=
of negligence on the part of my student technician or other employee, we w=
ould pay to replace or repair hardware for our users...that's just good cus=
tomer service. But in more than 12 years of operation, we've only replaced=
a single motherboard.

Subject: Language Request
Penn State is in the process of reviewing the indemnification language we u=
se on forms that we have students sign before we touch their computers. Cu=
rrently the language covers the issue of data loss but does not discuss any=
other area, such as hardware failure. Given the critical view students ha=
ve of their computers and the litigious society in which we live, we are st=
riving to make sure we provide the level of service that is expected but pr=
otect the University from unfounded legal action. I would appreciate any s=
haring of language that other schools use on the same types of forms they h=
ave students sign for normal trouble shooting as well as more complex actio=
ns such as formats and rebuilds.
