Indeed not.  Special Occupation Order No. 4 required that 200 local hostages be killed every two hours until a spy/saboteur is given up. (TOS "Errand of Mercy").  As to what happens to the spy himself:

  AYELBORNE: What are you going to do with him, Commander?
  KOR: What is always done with spies and saboteurs. He will be killed,
            after he has had first-hand experience of our mind scanner.

The surveillance device installed in Governor Kor's office on Organia wasn't hidden at all.  Kor nonchalantly pointed it out to Kirk who hadn't noticed it, presumably because he had never seen one before.  In fact, Kor commented proudly:

  KOR:  Do you know why we are so strong? Because we are a unit.
             Each of us is part of a greater whole.
