I consider something disseminated by a Usenet Newsgroup or a LISTSERV
or similar program to be publication, at least if it is a public list
like PACS-L. This is based on the idea that multiple copies are made
and widely disseminated, much as a journal or book is published. Of course
any three lawyers may offer three different opinions.
I also happen to believe that the quotes were within the guidelines of
"Fair Use" as I understand them.

I believe the source should have been indicated, especially since the
wording of the article sounded like they were quotes from a telephone or
personal interview. Of course, part of that may be because of the often
informal nature of the communications on lists, and that the messages
were not written as "scholarly articles". The fact that these publications
may be quoted may make us all write a little more formally, however. 8-)
I also believe the source should have been indicated even if these are NOT
publications, as journalists usually indicate something about the interview
that produced the quoted remarks.
I've received some off-list comments from the participant(s) in this
matter, and hope that they will make the same comments to the list. Since
I consider private mail to be just that....private....I leave it up to
them to share their comments to me more widely.
