   I think we're losing something here. If this goes away for every user, then
   I think every user should be allowed to create at least one list without
   having to ask for it.

We've had this discussion before; my suspicion is that most users never
take advantage of their list at all.  Is it that much of a problem to
ask users to send an email message to accounts in order to create that
first list?
