Cindy Cohn (one of Bernstein's attorneys) reports on another list that
the 9th Circuit has granted en banc review of the 9th Circuit opinion in
_Bernstein v Dept of State_. That means they'll redo oral arguments (I
can't remember if they'll also redo the briefs) and the court will then
deliberate, this time with 11 instead of 3 judges.
