The AUP became moot a long time ago, when NSF stopped enforcing it.

The fiction that NSF is enforcing it by "investigating" any complaints
it receives is about as realistic as expecting to enforce the 55mph
speed limit by only investigating all reports of violations that are
delivered totally documented and ready for prosecution to the local
police.

On second thought, the 55mph speed limit is much better enforced as
despite the near universal non-compliance, there are some small number
of violations actually prosecuted.


The AUP is the functional equivalent of anachronistic laws that
prohibit "cohabitation" or various sexual acts, even if your partner
is legally married -- everyone ignores then, but a small minority lives
in fear of selective enforcement.

Unless the AUP is fully and fairly enforced or repealed, it remains
a joke.
