All things considered, that's not an unreasonable approach.  For instance:

One of the oldest prohibited activities on the NSFnet is the dreaded
"sending of invoices".  Under the old no commercial use test, this is
clearly forbidden.  If you apply the "adds value" test, there's hope;
sending invoices within the context of an ANSI X12 EDI standardization
effort is clearly adding value to the net, and should quite reasonably
be encouraged.

It'll be nice to see some language in print or in a bill that can be
quoted as chapter and verse.
