Barry is right that there is little new here.
However, one new thing is the question of having the name and using it.
Trademark law will forbid anybody but MTV from using the name MTV when
it comes to music. It might not forbid somebody from having the name
registered.
Which means that people might still go out and register foo.com, not use
it and try to "sell" it to Foo Inc. later. Which is not a good thing.
I still think it would be nice to have app forms include a statement
saying "The applicant knows of no trademark conflict regarding the use or
ownership of this name."
