At Western Carolina University, IT only deals part of the DMCA Offenses and=
our Department of Student Community Ethics handles the rest. We have seen=
an increase over the last year, but this year our numbers have been off du=
e to our original registered DMCA Agent with the US Copyright Office having=
retired. As the new registered DMCA Agent, I am working with our Departme=
nt of Student Community Ethics to continually enhance and tweak our process=
.
As it stands this is what happens to students in violation:
Immediate disconnect of their internet connection. (Students are put into a=
specific VLAN we call the =1B$B!H=1B(BVOID=1B$B!I=1B(B in which they can a=
ccess all campus related sites, Blackboard, etc. but are unable to get outs=
ide of the University network.) Once the student gets their =1B$B!H=1B(BVO=
ID=1B$B!I=1B(B page, they contact IT and we verify that they hold the infri=
nging Mac Address and discuss the situation with them (with hopes to educat=
e them on what has happened) and then we link their contact information and=
name in our Cherwell ticket tracking system. That information with the li=
nked Notice ID that we received from the RIAA, MPAA, etc then gets passed o=
nto the Department of Student Community Ethics and they start their process=
.
*Wireless infringements, we locate the infringing Mac Address and then that=
information goes to Networking to have them match that infringing Mac Addr=
ess with the associated AD Credentials that are used to bind it to the wire=
less network* Student=1B$B!G=1B(Bs AD Credentials are immediately moved in=
to our =1B$B!H=1B(BVOID=1B$B!I=1B(B in which they can only access Universit=
y pages via the wireless network.
LAN line infringements, once the student contacts us and all information is=
verified, that student=1B$B!G=1B(Bs AD Credentials are also moved into the=
VOID for a wireless disconnect. *We=1B$B!G=1B(Bve had way too many studen=
ts try to bypass the process when they were realizing they could still acce=
ss the wireless network*
First Offense:
*Student pays an assessment fee of $50/song (max out at $250) and $100 for =
everything else (this is a flat fee at the moment but we are considering ch=
anging it to a max of $200 or $300 due to the number of movies students hav=
e been downloading in one offense).
*Student loses internet connection until they take the online =1B$B!H=1B(BR=
esponsible Computing Course=1B$B!I=1B(B through Blackboard which is related=
to Copyright Infringement. There are 310 questions and they must pass wit=
h an 85% or higher to have their internet reinstated. IF they fail the exa=
m, they must wait 48 hours before they can make another attempt.
*Some students in the past have had other sanctions placed on them but that=
is left up to the Department of Student Community Ethics and the student=
=1B$B!G=1B(Bs Resident Director.
Second Offense:
* Student pays an assessment fee of $50/song (max out at $250) and $100 for=
everything else (this is a flat fee at the moment but we are considering c=
hanging it to a max of $200 or $300 due to the number of movies students ha=
ve been downloading in one offense).
* Student loses internet connection for 2 months from the date of the settl=
ement with the Department of Student Community Ethics (they notify me of th=
e date in which it=1B$B!G=1B(Bs officially =1B$B!H=1B(Bsettled=1B$B!I=1B(B =
and the date in which to reinstate it)
* Other sanctions are determined by the Department of Student Community Eth=
ics or RD
Third Offense:
* Student pays an assessment fee of $50/song (max out at $250) and $100 for=

This year we had our first student to have been in violation of their third=
offense. We are also currently working on ways to get the information out=
to them on the DMCA, HEOA as well as University Policies that they would b=
e violating.
The Blackboard course will be changing this spring and my goal is to make =
them watch a video and a power point presentation prior to taking the exam =
and then letting them have a set amount of time in which to take the exam. =
I also plan to have a good set of questions that it will cycle through so =
those students who have taken the exam multiple times can=1B$B!G=1B(Bt chea=
t and just write the answers down.

We are currently revising our strategy for dealing with RIAA notifications.=
We are considering constructing a Desire to Learn course which offenders w=
ould be required to "pass."
Right now we aren't providing enough initial education as new students arri=
ve on campus, we also are not utilizing any shaping technology to curb ille=
gal activity. So as you can imagine we receive lots of these letters. We ar=
e working on the shaping and education parts, but right now we have a signi=
ficant number of letters to deal with.
The following is a draft of our proposed sanction process:
First Offense: you will receive a letter and you will be required to comple=
te D2L course in X
amount of time. Future DMCA violations until X date passes are considered o=
ffense #1.
Second Offense: you will receive a letter and be required to submit to an o=
ffice visit with the
Student Rights and Responsibilities staff, with a Technology Services staff=
member present.
Your network resources will be revoked in your room and on wireless. Future=
DMCA violations
until this meeting has been completed are considered offense #2.
Third Offense: you will receive a letter and be required to submit to a sec=
ond office visit with
the Student Rights and Responsibilities staff, with a Technology Services s=
taff member present.
In addition to the network resources being revoked, your W=1B$B!>=1B(Bnumbe=
r (access to network resources) will be turned off for the
course of Y months. Future DMCA violations until this meeting has been comp=
leted are
considered offense #3. Months will be calculated in academic year months, i=
ncluding only the
traditional 9 months of fall and spring semesters.
I'm wondering what other schools are doing to enforce policy once someone r=
eceives a letter, or if anyone is using D2L or Blackboard to create an educ=
ational courses?

curb illegal activity. So as you can imagine we receive lots of these lette=
rs. We are working on the shaping and education parts, but right now we hav=
e a significant number of letters to deal with.<br><br>The following is a d=
raft of our proposed sanction process:<br><br>First Offense: you will recei=
ve a letter and you will be required to complete D2L course in X<br>amount =
of time. Future DMCA violations until X date passes are considered offense =
#1.<br><br>Second Offense: you will receive a letter and be required to sub=
mit to an office visit with the<br>Student Rights and Responsibilities staf=
f, with a Technology Services staff member present.<br>Your network resourc=
es will be revoked in your room and on wireless. Future DMCA violations<br>=
until this meeting has been completed are considered offense #2.<br><br>Thi=
rd Offense: you will receive a letter and be required to submit to a second=
office visit with<br>the Student Rights and Responsibilities staff, with a=
Technology Services staff member present.<br>In addition to the network re=
