I haven't brought up the idea of a legal response here yet, but I need to
respond to the second point.
We are assuming that the Brilliant Digital:Altnet is going to use the
Kazaa protocol and not something less visible such as HTTP port 80 or even
worse HTTPS port 443 or SSH, or FTP, or....
Considering the type of content and purpose it sounds a little more to me
like a CDN (content delivery network) similar to Akamai. The difference
being that instead of asking to place equipment at various key network
sites with approval and possible compensation we have an organization just
grabbing whatever systems appear to be placed in "convenient" locations
with legally questionable approval.
