Dear Members of Council,
At this time, the Judicial Board is not able to reach a consensus =
decision regarding whether or not the complaint we have received =
represents sufficient grounds for a removal discussion based on the =
standards set out in the Constitution.
This has happened for a number of reasons:
1) Some of the elements in the complaint were frivolous and we needed to =
spend time deciding to eliminate them from consideration
2) Though we received the complaint well within the required time for =
consideration, it was at the end of Spring Break and we were not both =
back on campus available for meetings.
3) A number of students have requested additional meetings with us and =
we have made ourselves available to them as best as possible
4) Little precedent is available to us and we need to exercise =
considerable care in this decision given the severity of removal action
5) Because the President and Council did not appoint and confirm a =
third member of the Judicial Board we do not have a tie-breaking =
capability and thus need to be precisely sure that the decision =
represents both of our opinions adequately. Given that appointing a new =
member at this time would probably become a proxy for removal action we =
believe that a unanimous decision is our best and only available option
6) Although this is not a judicial reason=E2=80=A6 we are both students =
just like you and have pressing commitments related to our success at =
MIT.
Ultimately, we feel that at this time it would be best to request that =
the UA set an additional meeting no earlier than next Wednesday to =
account for the possibility that the removal discussion may go forward. =
Although the Judicial Board is meant to render quick and faithful =
judgments, the reasons we have outlined here have placed our ability to =
be both quick and faithful simultaneously at risk. And although we =
acknowledge that removal discussions are supposed to happen only at =
regularly scheduled meetings within three days of a complaint, we would =
say that our need for additional time to render a faithful decision =
warrants this particular exception.=20
