This is correct. The constitution is only a bar on government action
(the FDR court's expansion of the interstate commerce clause beyond
all reason aside -- that's another flame) and thus does not apply to MIT.
There is a MA law that forces some public institutions to guarantee
some MA const rights ^^^^^^private
so that might apply.
But in general, one would hope that a university, a place supposedly
devoted to learning, questing, enlightenment, free thinking, etc.,
would WANT to do AT LEAST as well as the govt in terms of protecting
free expression. This is what I'd appeal to, re: MIT.
(note: if MIT was a state school, like UMass, then the Const (both
fed and state) does directly apply).
