FelonyNo, There is no right to affiliation with the University which such
establishment entails. The University could not interfere with the
formation of an APHIO chapter made up of students of that university if it
did not use university resources (as most do) and did not claim to be
affiliated with the university in any way. A Constitutional right to free
speech does not imply the concurrent right to make the government pay for
that speech. Others pay for the right to use the universities name and
marks. At least every university with a major sports team reaps significant
benefit from such licensing. HOWEVER, I believe that APHIO does not permit
such chapters to be created.

assemble, then isn't it technically a violation of the Constitution for a
school, especially a public college, to bar the organization of fraternities
without due cause, such as a prior or existing incident of hazing in the
fraternities in question?
