I wonder about the feasibility of splitting the Fraternity, from a legal
standpoint. If we had to go co-ed in the first place to retain our
non-profit status under Title IX, would the creation of an all-male branch
of the fraternity cause that status to be revoked? Would an all-male APO
even qualify as non-profit? If not, that organization loses a great deal
of the resources needed to serve others-- which is still our primary goal,
no matter how you want to interpret Horton's words.
All-male chapters would also necessarily have to be formed at private
colleges, because of Title IX. I don't know where the schools are that
Jesse referred to in his message, but I'm willing to bet that some of them
are state-funded.
In general, the only aspect of chapter operations a change like this would
impact positively (and some might even question that) would be social, and
it would do so at the expense of service-- which seems to me to be a bad
trade. Combine that with the administrative difficulties that would
inevitably arise, and it seems like more bureaucratic trouble than it's
worth. Though I will not dispute the right of all-male chapters to remain
so, I disagree with the idea that they should be made (invited, in fact)
to feel more separate from the National Fraternity than they already do.
