Yep. The drive explicitly reports it has problems with the disk surface.
Now, in theory this could also mean it is not (low level) formatted at
all, but I think there is an explicit FORMAT ERROR defined to be returned
in this case.

Nevertheless (if you did not yet), you might want to try to low level
format this new disk before you return it to the vendor, maybe this is the
problem. Of course, if it is has real surface problems, reformatting might
cure these too, but typically only for a short while.
