Incorrect. You can't buy a Linux Kernel. The only thing that allows
you to use it is the GPL. If you consider the GPL invalid in one
aspect you must be simply refuse it. And without the GPL you have no
right whatsoever to use a Linux Kernel.
If the GPL says you can not link staticly with the kernel and you do
you are stealing intelectual property when using a Linux kernel since you
have invalidated the same licence that gives usage rights.
What you are assuming is that no one will sue someone for stealing this
intellectual property. That does not make the act less ilegal.
