In principal, I agree with you that economics is the preferred way to
regulate. The problem is that this activity could very well be at the
request of the government. The only services that will be available will
be those that are government approved. So another way to look at the
situation is that the people need to pressure their "representatives" to
sign a contract with the "represented" that this activity will not take
place. This contract could take the form of a piece of legislation
outlawing the offending practice.

Just another basis from which to view things.
