Proponents of jury nullification often fail to mention the most famous
recent success of this doctrine: the O. J. Simpson acquittal.
While Johnnie Cochran was not able to explicitly ask the jury to ignore
the law, he alluded to their conscience and to their ability to send
a message. The jury was asked to consider the racism of the LAPD,
exemplified in particular by Mark Fuhrman, and to deliver a verdict that
would condemn the LAPD and legal system for mistreatment of blacks.
Cochran's cleverly worded appeal succeeded, and as a result, a killer
walks among us.
What a triumph for jury nullification!
