HIGH COURT STRIKES DOWN "TINY TOWN" LAW

For "Tiny Towns" from Memphis to Elizabethton, the state
legislature giveth and the state high court taketh away.

The Tennessee Supreme Court yesterday struck down a controversial
state law that made it much easier for towns to incorporate on
the edges of existing cities, dashing hopes for tiny towns
statewide.

In a one-paragraph court order, the Supreme Court said the law
was unconstitutional because the title on the legislation that
brought it about did not accurately describe what it did.  The
law, intended to allow one community in Lt. Gov. John Wilder's
Weststate senatorial district to incorporate, passed the
legislature with little debate last spring.  It inadvertently
rewrote the state's incorporation laws ...

Lawmakers later complained they did not understand what they were
voting on. ...
