And what if you are your own ISP? I see a number of problems legally with
requiring someone to keep incriminating details about themselves as a part
of businesses.
Also, will this require keeping a mirror of a person's mail spool? That
could get quite expensive for thos of us on many, many mailing lists.
Sounds like they have compiled a wish list, are trying to get it made into
a law and then hand it over to the ISPs and say "you make this idea work
for us".
The net will soon fall to micro management...

That's my exact situation, I'm my own ISP. I give a handful of accounts out
to personal friends and that's it. I believe we have a constitutional
amendment that would require probable cause and a warrant to get me to tap
my own, or my friends, communications. Besides I could always throw my
friends off and invoke the 5th.
I simply refuse to expend any system resources outside the 4-day resend
period in sendmail. I don't run an archive site. If somebody wants me to
spend my time, money, and resources doing this sort of stuff I have a bill
to send them at $80/hr for the labor plus expenses.
