One could even argue that since at no point is a mechanism described that
puts POTUS in charge of the navy nor a mechanism for an act of Congress to
do it, that any actions by Congress that transfers that command out of the
legislative branch is unconstitutional. In other words, the navy is never
under the executive branch and are in fact immune from executive orders
(nuclear sub release code mechanisms come formost to mind).

Sorry, simply ain't so. Not sure what I was thinking (the down side to
writing off the cuff), should have checked before I sent it, when it clearly
says "...army and navy...". This section should be removed completely.
I don't believe it impacts any of the other points.
