Yes, but the effect of the wording of this bill is to separate the
interests of privacy advocates from those of their erstwhile allies,
the software industry, and to get the big money and large lobbies out
of the privacy battles.

Microsoft et al. have absolutely no interest in privacy concerns,
unless their bottom lines depend upon them.  This clause costs them
nothing, so agreeing to a bill that erodes the constitutional rights
of US citizens, in exchange for eased export restrictions, is a
winning strategy for them.
