Snailmail is different; there are specific treaties to cover it.

I didn't say the border sites *should* be liable; I just think they
probably *are*.  They don't have common carrier status, after all.

Saying what the law should be doesn't change what it is.  You can
lobby to change it, but it won't help you in court.
