Except that it was addressed only to current subscribers to (? one of
his other publications?).  If it were an offer to the Net at large (as
with Jayne Levin's _Internet Letter_ [pretty good, by the way]), that
would be different; as it is, he should've handled it by mailing only
to his subscribers.
