Judges don't make the law.  The Constitution does not stipulate the
fines or terms of jail for offenses, or even the various levels of
offenses.  There has to be a law to do that.

Sometimes.  But usually these standards are codified by law.  That's
what the current bill is all about now.  As with mandatory minimums,
imposing strictures on the court is not usually the answer.
