Yes! I think the First Amendment should apply nicely.
I certainly hope your counsel will make that point vociferously
during litigation (as I'm certain they're well equipped and
prepared to do).
Incidentally, I think it's also extremely important that
we make sure carriers of the digital media be absolved of legal
liability for the content they carry, as long as they remove
themselves from editorial control of that content.
