The case file in the Sprint protest is B-256586. This case is required to
be completed no later than July 6, 1994. I have been placed on the
initial distribution list to receive a copy. Just because July 6, 1994 is
the date for the case to be finished does not mean that it will not be
completed at an earlier date.
I have explained to others that "active cases" are not allowed out of the
government offices and in most cases are not subject to FOIA request.
Even after a case at the GAO is finished does not mean that the GAO will
turn over the documents to the general public. One thing about the GAO,
they are a very responsible agency. While under the 5 U.S.C. 552 an FOIA
request does not apply. The GAO does in fact agree that C.F.R. Part 81.1
GAO's disclosure policy follows the Spirit of the Freedom of Information
Act. In that Spirit the GAO has been very cooperative.
Further C.F.R. Part 81.3 (a), (b), (c) as well as C.F.R. Part 81.4 (b), (c).
and C.F.R. Part 81.5 (a), (b) are also excellent areas to research. This
process is designed to be very fair to all parties concerned.
When correctly filed, comments regarding the protest can be attached to
the protest file. Note that I say, when correctly filed. ( Please on this
point - look filing up in the C.F.R. Rules).
With regards to comments about Steve Wolff at the NSf.. I would expect to
see nothing less than complete and total silence on the part of Steve. If
he were to make comments about this protest before it has a chance to be
acted on it would at the very least in my opinion be improper. I doubt
that Steve will make any such comments. (Noting his lack of response here
on Com-Priv). Also note that this protest at its first filing contained
information that related to allegations Sprint claims were made on
Com-Priv. I think that this is best heard in the GAO offices at this time.
Last: I have filed a document with the GAO and they will be getting it
later this week. I will publish the results of the GAO response when I
receive it.
