Well people life gets interesting. I have requested any and all copies of
the paperwork that Sprint has filed in their protest against the NSF
pre-award announcement. I have requested and and all documents filed in
the last 7 days as well. Further, I have requested copies of the response
from GAO and the NSF to this protest by Sprint.
Next: I have sent the GAO a letter asking for an explaination of the
pre-award protest, dates of any and all hearings. Under the CFR rules I
more than qualify as an interested party. Am I interested.
The protest is filled with alot of allegations, allegations that are not
based on any factual information at the TIME OF FILING. Sprint is NOT
allowed to file a PROTEST and then go fishing. This is exactly what they
did and as much as I do not like it, its grounds for the GAO to dismiss.
To the NSF I say - get on with it. To MCI I say - No need for any
concern. Its a poorly written pre-award protest written by a sore loser.
Coupled with remarks made about this entire process I don't think that
the government should wait. DISMISS the protest based on its MERIT at the
time of Sprints first filing. Award the contract to MCI as planned. If
Sprint wants to continue to use the PROTEST process to impede the AWARD
process BAR them by agreeing to hear their PROTEST but, in parallel with
the Sol. award and allow MCI to start with the job. If the PROTEST is
found to have MERIT at a later date , based on the info. first filed ,
then there will be grounds to suspend the MCI award at that time. Until
this happens, it is NOT IN THE BEST INTEREST OF THE GOVERNMENT to allow
sucha frivolous PROTEST to continue. I don't care how much extra
information is turned up in the meantime. The PROTEST process was not
intended to allow people to HALT things and then go exploring.
Many of you will not agree and that is fine, you may look for a posting
from me in the next day or so on the CIX. I have some pointed remarks and
direct comments regarding their actions and lack of that I will be
posting as well.
Happy Easter from those of us on Universial Cood. Time !
