1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.8 Section 1. _PURPOSE.]
1.9 \UThe purposes of this act are to establish a process:\u
1.10 \U(1) for improving public access to government information\u
1.11 \Uand data, and therefore for improving the democratic process,\u
1.12 \Uthrough the use of information technology; and\u
1.13 \U(2) for helping government become more efficient,\u
1.14 \Ueffective, and responsive to the public through the use of\u
1.15 \Uinformation technology.\u
1.16 Sec. 2. _15.95] _ACCESS MINNESOTA BOARD.]
1.17 \USubdivision 1.\u _CREATION.] \UThe Access Minnesota board is\u
1.18 \Ucreated to advance, improve, plan, coordinate, and oversee the\u
1.19 \Uprocess of developing and maintaining the Access Minnesota\u
1.20 \Usystem for the provision of government information and services\u
1.21 \Uin an electronic form. The board consists of the following\u
1.22 \Umembers, appointed by the governor:\u
1.23 \U(1) five representatives of state and local government;\u
1.24 \U(2) four members of the general public who represent a\u
1.25 \Ubroad cross section of those interested in the issues related to\u
1.26 \Uthe board's work;\u
2.1 \U(3) one public librarian; and\u
2.2 \U(4) one librarian who manages government information\u
2.3 \Upursuant to section 15.18.\u
2.4 \UMembership terms, compensation, and removal of members are as\u
2.5 \Uprovided in section 15.0575.\u
2.6 \USubd. 2.\u _DEVELOPMENT OF ACCESS MINNESOTA SYSTEM.] \UThe\u
2.7 \Uboard is responsible for supervising the development and\u
2.8 \Uoperation of the Access Minnesota system, a statewide,\u
2.9 \Ucomprehensive, and coordinated system of public access to\u
2.10 \Ugovernment information, data, and services which utilize a wide\u
2.11 \Uarray of information technologies.\u
2.12 \USubd. 3.\u _PRINCIPLES.] \U(a) The board must adhere to the\u
2.13 \Ufollowing principles in planning and oversight of the system:\u
2.14 \U(1) the system must be designed primarily from the\u
2.15 \Uperspective of citizen users, and must allow for broad citizen\u
2.16 \Uinvolvement in the system's development and growth;\u
2.17 \U(2) the components, applications, and demonstration\u
2.18 \Uprojects of the system must be open, accessible, and easy for\u
2.19 \Ucitizens to use;\u
2.20 \U(3) the system must seek to provide the greatest possible\u
2.21 \Upublic access to the widest possible array of public government\u
2.22 \Udata and information maintained by state or local governments,\u
2.23 \Uincluding open access through libraries, schools, nonprofit\u
2.24 \Uorganizations, businesses, and homes;\u
2.25 \U(4) the system must include the ability for government\u
2.26 \Uunits to provide information, data, and services in a\u
2.27 \Udecentralized and convenient manner through electronic means,\u
2.28 \Uincluding electronic kiosks, computer networks, and\u
2.29 \Utelephone-based and facsimile services; and\u
2.30 \U(5) except to the extent necessary to achieve the goals set\u
2.31 \Uout in subdivision 8, the system should not duplicate services\u
2.32 \Uavailable from private providers.\u
2.33 \U(b) The board and the Access Minnesota system are subject\u
2.34 \Uto chapter 13.\u
2.35 \USubd. 4.\u _CONTRACT.] \UThe board shall contract with a\u
2.36 \Uprivate or public entity to assume primary responsibility for\u
3.1 \Uplanning, developing, implementing, and maintaining one or more\u
3.2 \Ustatewide systems for providing access to government data and\u
3.3 \Uservices. Before entering into a contract, the board must\u
3.4 \Urequest proposals by publishing notice in the State Register and\u
3.5 \Uin other publications likely to encourage responses from\u
3.6 \Upotential bidders. A contract under this subdivision may not\u
3.7 \Uextend for more than three years.\u
3.8 \USubd. 5.\u _OTHER DUTIES.] \U(a) The board shall:\u
3.9 \U(1) coordinate statewide efforts by units of state and\u
3.10 \Ulocal government to plan for and develop a system for providing\u
3.11 \Uthe data and services in the manner required by this section;\u
3.12 \U(2) coordinate and assist demonstration projects;\u
3.13 \U(3) assure intergovernmental cooperation and collaboration,\u
3.14 \Uincluding the use of appropriate general standards and protocols\u
3.15 \Uas developed by the information policy office;\u
3.16 \U(4) advise units of state and local government on provision\u
3.17 \Uof government data to citizens and businesses;\u
3.18 \U(5) develop a common access point to public information\u
3.19 \Uwhich must utilize the department of administration's statewide\u
3.20 \Utelecommunications network, if appropriate;\u
3.21 \U(6) provide appropriate oversight of the contractor\u
3.22 \Uselected under subdivision 4;\u
3.23 \U(7) explore ways and means to improve citizen and business\u
3.24 \Uaccess to public data including implementation of any\u
3.25 \Utechnological improvements; and\u
3.26 \U(8) explore ways to measure the number and type of\u
3.27 \Ugovernment organization services offered electronically to the\u
3.28 \Upublic and the effectiveness of the services in meeting the\u
3.29 \Uneeds of the public.\u
3.30 \U(b) In fulfilling its duties under this subdivision, the\u
3.31 \Uboard shall seek advice from the general public, government\u
3.32 \Uunits, system users, professional associations, libraries,\u
3.33 \Uacademic groups, and other institutions and individuals with\u
3.34 \Uknowledge of and interest in such areas as networking,\u
3.35 \Uelectronic mail, public information data access, advanced\u
3.36 \Utelecommunications, and electronic transfer and storage of\u
4.1 \Uinformation.\u
4.2 \USubd. 6.\u _POWERS.] \U(a) The board may:\u
4.3 \U(1) negotiate and enter into contracts for professional\u
4.4 \Uconsulting, research, and other services; and\u
4.5 \U(2) accept gifts, donations, and grants.\u
4.6 \U(b) The board may hire an executive director to assist it\u
4.7 \Uin carrying out its duties. The commissioner of administration\u
4.8 \Ushall provide office space, support staff, and other support\u
4.9 \Uservices to the board.\u
4.10 \USubd. 7.\u _MANAGER.] \UThe entity selected under subdivision\u
4.11 \U4 to implement and maintain the system shall, under direction of\u
4.12 \Uthe board:\u
4.13 \U(1) direct and supervise the day-to-day operations and\u
4.14 \Uexpansion of the system, including the initial development and\u
4.15 \Uoperation necessary to make the system operational;\u
4.16 \U(2) enter into contracts with other entities, with the\u
4.17 \Uapproval of the board, for purposes of implementing and\u
4.18 \Umaintaining the system;\u
4.19 \U(3) attend the board meetings;\u
4.20 \U(4) keep a record of all network and related operations of\u
4.21 \Uthe system and maintain and be a custodian of all financial and\u
4.22 \Uoperational records, documents, and papers filed with the board;\u
4.23 \U(5) develop outreach, training, and education efforts to\u
4.24 \Umake the public and units of state and local government aware of\u
4.25 \Usystem activities, and other issues related to this initiative;\u
4.26 \Uand\u
4.27 \U(6) prepare and revise strategic and operational plans on\u
4.28 \Uan annual basis for the system.\u
4.29 \USubd. 8.\u _ACCESS TO DATA.] \UThe legislature determines that\u
4.30 \Uthe greatest possible access to certain government information\u
4.31 \Uand data is essential to allow citizens to participate fully in\u
4.32 \Ua democratic system of government. The board must assure that\u
4.33 \Uthe systems provide information and data, including, but not\u
4.34 \Ulimited to the following, free of charge:\u
4.35 \U(1) directories of government services and institutions;\u
4.36 \U(2) legislative and rulemaking information, including\u
5.1 \Upublic information newsletters, bill text and summaries, bill\u
5.2 \Ustatus information, rule status information, meeting schedules,\u
5.3 \Uand the text of statutes and rules;\u
5.4 \U(3) all public data on state agencies contained in the\u
5.5 \Ustatewide accounting system;\u
5.6 \U(4) official documents, releases, speeches, and other\u
5.7 \Upublic information issued by the governor's office and\u
5.8 \Uconstitutional officers; and\u
5.9 \U(5) the text of other government documents and publications\u
5.10 \Uthat the board determines are important to public understanding\u
5.11 \Uof government activities.\u
5.12 \UThe board, on a continuing basis, shall identify and take\u
5.13 \Uaction to ensure that identified government data are available\u
5.14 \Ufree of charge.\u
5.15 Sec. 3. _REQUESTS FOR PROPOSALS.]
5.16 \UBefore November 1, 1994, the board shall request proposals\u
5.17 \Ufrom a private or public entity for planning, development,\u
5.18 \Uimplementation, and maintenance of the coordinated and common\u
5.19 \Uaccess system for providing access to government information and\u
5.20 \Uservices as required by section 2. Based on responses to the\u
5.21 \Urequest for proposals, by January 15, 1995, the board shall\u
5.22 \Ureport to the legislature on the short-term and long-term costs\u
5.23 \Uto the state associated with planning, development,\u
5.24 \Uimplementation, and maintenance of the system. The board shall\u
5.25 \Ualso report on how and the extent to which these costs should be\u
5.26 \Upaid by the state or other units of local government, and if it\u
5.27 \Uis desirable and to what extent these costs could be recovered\u
5.28 \Uby imposing fees on certain users of the system. The board's\u
5.29 \Ureport shall also recommend any changes in state law needed to\u
5.30 \Uimplement the system, including whether it is appropriate to\u
5.31 \Ucharge fees to certain users.\u
5.32 Sec. 4. _APPROPRIATION.]
5.33 \U$....... is appropriated from the general fund to the\u
5.34 \Ucommissioner of administration in fiscal year 1995 for the\u
5.35 \Upurpose of assisting the Access Minnesota board in carrying out\u
5.36 \Uthe duties required by section 3.\u
