Not necessarily.

Yes, perhaps through another AS.

Nothing in the agreement(s) prohibit transit use.  They just give one
model.  In fact, the CIX charges an additional fee (they have to buy a 
port and CSU/DSU) for a direct attachment.

Sprint, for example, will provide transit to the CIX for resellers <provided> 
you are a member.  This is what MCSNet has done.  We purchased transit 
service from Sprint, and a membership from the CIX.  That's perfectly 
legit according to both the CIX and Sprint.  And, in the end, that's all
that matters (that all parties agree).

We're AS 3365.

ANS will do the same thing, and is perfectly within its rights to do so.
