In the article a company spokesman said that the user has to agree to the
"hidden" P2P network's activation before it will work.

Unfortunately, that means that they can argue that the users authorized the
use of that bandwidth and thus they are not be liable.

I like your thinking though :)

How nice of them to ask our students' permission to use our University's
excess bandwidth.


Looks like a ripe opportunity for higher education to file suit against a
company for using resources without securing permission from someone
actually authorized to grant it.
