I don't think any one has mentioned this yet, but I think that AOL got a
section added to the DMCA that immunizes ISPs/NSPs from the copying that
occurs in the operation of the network. AOL, of course, does lots of
caching.
A content person would have a *very* steep hill to climb in trying to
argue that an ISPs decision in how to operate their network is somehow
beyond the scope of this immunization.
