They range from First Amendment implications to the extent of aire investor Peter Thiels involvement and the fate of two of Gawkers most recognizable faces, Denton and exeditor A.J. Daulerio. Observers of the case are now left wondering what would have happened if it continued with its appeal of Hogans judgment. Those left asking what if may be wondering of the private details behind the financing of Hogans lawsuit, which was secretly funded by aire investor Peter Thiel, or the First Amendment boundaries that could have been tested on appeal. On Monday, before news of the settlement agreement broke, Thiel said in an interview at The National Press Club in Washington, D.C. that when he decided to fund the Hogan case, he was confident in the outcome. Thiel said this is partly because the case was centered on claims of invasion of privacy, rather than libel or defamation, which require the plaintiff to reach a high bar to prevail. Townsend agreed with Thiels reasoning, adding that juries are often sympathetic to an individuals privacy. Where Townsend and Thiel disagree, she said, is Thiels assessment that his bankrolling of the Hogan case wont set a precedent for other wealthy individuals to sue media outlets they dislike. Im sure in Peter Thiels mind, he believes that Gawker was a particularly bad actor, Townsend explained. That being said, the question that this all boils down to is, who gets to decide that a media organization should no longer exist
We like reporting on the tiny, minuscule improvements to the Android and Google platforms here at Android Police, so we were delighted to find that in the Google Play Store, older devices have disappeared on the list of My Devices. This is pretty small and insignificant to most, but its something that will have bothered many hardcore Android fans, so its good to see it fixed. Previously, every device you have ever owned would be listed, right from the first Android device you used (mine was a Nexus One) to the most recent. There is still no function to manually remove a device it still has to be told not to appear in menus and it still shows when it was registered and last used.
Perhaps the biggest reason the case is ending in a settlement has nothing to do with the law, but rather money; or lack thereof. Denton hinted at the heavy financial burden the case had placed on Gawkers estate, saying in his response to the settlement that an allout legal war with Thiel would have cost too much. Katie Townsend, litigation director at the Washington, D.C.based Reporters Committee for Freedom of the Press, said that while the result of the case was understandable from the financial perspective of a bankrupt estate, its disappointing from a legal one. The claims that Hulk Hogan prevailed on, were not going to see those tested on appeal, Townsend said. I think it does some precedent, not in a legal way, but in a very real way, for future plaintiffs who may be emboldened to do this kind of thing, because we know juries can have a different reaction to privacy claims than a court would necessarily support.
Marburger only recently began representing Daulerio, who lacked a lawyer after the plaintiffs argued that Gawkers legal team could no longer represent him due to a conflict of interest. Even if the settlement is approved, Daulerio may still face the possibility of additional legal action. Im very grateful for all the support I received from past and present Gawker media employees and Im sorry this settlement offers no vindication to them whatsoever, Daulerio said in an email to FORBES. That being said, this whole ordeal has brought out the worst in everyone involved. I look forward to it finally ending so we can all work on becoming better people.
