President Obama is doing anything but closing out his lame duck term quietl=
y. On the contrary he=C3=A2=E2=82=AC=E2=84=A2s doing yet another end run ar=
ound both the U.S. Congress and all 50 states, imposing yet another mandate=
that will cost money and jobs, possibly forcing states to raise taxes as w=
ell.
Twenty-one states have filed a federal lawsuit in U.S. District Court in Sh=
erman, Texas, to stop him. Hours after the states filed their lawsuit, the =
U.S. Chamber of Commerce and other business groups filed a similar lawsuit =
with the same federal court.
Obama=C3=A2=E2=82=AC=E2=84=A2s new mandate would force employers in all sta=
tes to pay overtime to certain state employees. These employees include =C3=
=A2=E2=82=AC=C5=93bona fide executive, administrative, or professional=C3=
=A2=E2=82=AC=C2=9D workers as they are not covered by the federal law that =
requires states to pay overtime for work performed beyond 40 hours in a wee=
k. The mandate applies to both private and public sector employers.
On the surface this sounds somewhat sensible. Why shouldn=C3=A2=E2=82=AC=E2=
=84=A2t any state worker =C3=A2=E2=82=AC=E2=80=9C or private sector worker =
contracted by the state =C3=A2=E2=82=AC=E2=80=9C be eligible for overtime i=
f they work more than 40 hours in a week? One reason why this hasn=C3=A2=E2=
=82=AC=E2=84=A2t happened yet is many states are strapped just trying to ba=
lance their current budgets. Mr. Obama=C3=A2=E2=82=AC=E2=84=A2s lack of hop=
e and change, much less his promised economic recovery, hasn=C3=A2=E2=82=AC=
=E2=84=A2t helped.
The law says it should be up to the individual states first to decide if, a=
nd when, they should make such a change. Then they can ask Congress to chan=
ge the law, and it=C3=A2=E2=82=AC=E2=84=A2s up to Congress to have the fina=
l say.
This action by the Obama administration violates the Fair Labor Standards A=
ct =C3=A2=E2=82=AC=E2=80=9C only Congress has the power to establish a fede=
ral hourly minimum wage. It also violates the Constitution as it forces sta=
tes to pay their workers higher wages at the expense of state budgets, serv=
ices and governmental programs.
Obama actually put this in motion a couple of years ago when he told his La=
bor Department to change this exception for =C3=A2=E2=82=AC=C5=93white coll=
ar=C3=A2=E2=82=AC=C2=9D state employees. The department has now raised the =
minimum salary cutoff for overtime by more than double. The new rule also f=
orces states to raise that cutoff even higher every three years.
