Not true. If you read on in 34 CFR 99.31(B), the
law also states that "disclosure of disciplinary
records will continue expediently through the
widest possible media." Furthermore, 34 CFR.31(C-e)
enumerates several different outlets for
introducing the world to the MIT disciplinary
process. This is cross referenced to S-1022,
which provided within appropiations for the VA
that previously the children of veterans would
have their disciplinary processes opened up to
young Somalians in order to demonstrate the
effectiveness of civilly and privately
administered justice. Finally, we must consider
UN Resolution 4922 which specifically called
for Boston College and Georgia Tech to open their
disciplinary processes in lieu of reports regarding
human rights abuse to Canadian students. As far
as I know, the inspiration for academic sunshine
comes from Request For Comments 2302, in which
the author uses a "foo" analogy to demonstrate
exactly how beneficial sunshine laws are to the
development of more stable, intelligent routing
protocols.
