detained while trials were pending and
insist that it will withstand court scrutiny. A federal agent convicted
for the first time under the Kansas law could face six months
in prison, though probation would be the presumed sentence."These hard-working
federal employees cannot be forced to choose between the risk of a
criminal prosecution and the continued performance of their federal duties,"
Barry Grissom, the U.S. attorney for Kansas, said in a statement Thursday. But
Kobach called Holder's analysis "simplistic and incorrect" and said the
Kansas law is valid to protect the state's residents against unconstitutional
measures enacted by Congress."We are very, very confident of our position,"
Kobach said in an interview. "The state of Kansas is not in
any way afraid of a legal challenge."The office of Kansas Attorney General
Derek Schmidt has already anticipated a potential legal challenge from the
federal government, and has asked legislators to increase its budget by
$225,000 over the next two years to cover litigation costs.Stoneking said
a dispute could arise after a local gunsmith sells a firearm manufactured
in Kansas to a state resident without complying with federal requirements
for a background check on the buyer or registering the gun. Kobach
agreed."Until that actually happens, there won't be any litigation," Stoneking
said. "The federal government will have to have some way of finding
out."Supporters of the Kansas law have sa
that appeal is under way, meaning only Plan B One-Step would
appear on drugstore shelves until the case is finally settled. If Korman's
order isn't suspended during the appeals process, the result would be "substantial
market confusion, harming FDA's and the public's interest" as drugstores
receive conflicting orders about who's allowed to buy what, the Justice
Department concluded.Reluctant to get drawn into a messy second-term spat
over social issues, White House officials insisted Wednesday that both the
FDA and the Justice Department were acting independently of the White House
in deciding how to proceed. But the decision to appeal was certain
to irk abortion-rights advocates who say they can't understand why a Democratic
president is siding with social conservatives in favor of limiting women's
reproductive choices.Current and former White House aides said Obama's approach
to the issue has been heavily influenced by his experience as the
father of two school-age daughters. Obama and Health and Human Services
Secretary Kathleen Sebelius have also questioned whether there's enough
data available to show the morning-after pill is safe and appropriate for
younger girls, even though physicians groups insist that it is.Rather than
take matters into his own hands, the Justice Department argued to the
2nd U.S. Circuit Court of Appeals that Korman should have ordered the
FDA to reconsider its options for regulating emergency contraception. Th

<p style="font-size:xx-small;">ddition to cash-strapped county coffers, especially in the Northwest.
In recent years, the law has acted as a subsidy for states
and counties hard hit by logging declines triggered by measures to protect
threatened species.Idaho's Valley County, for example, would have to return
more than $128,000 from its budget of $2.5 million for roads and
schools. That leaves Gordon Cruickshank, chairman of the Valley County commission,
in a no-win position. Should he forgo the repaving of even a
single mile of the county's 300 miles of paved roads, defer maintenance
on a bridge or lay off two county employees?"We are struggling really
hard now to figure out what to do," Cruickshank said. "It's a
tough pill to swallow that they sent these payments out just a
few months before sequestration, and now they want them back."The Forest
Service has paid billions of dollars to counties over the decades, but
the receipts dwindled as logging on national forests dropped precipitously
in the 1990s -- first in the Northwest to protect the northern
spotted owl and salmon, and then later across the country as concerns
grew over the impact of clear-cut logging on wildlife and clean water. In
2000, Wyden led the charge for a new law, called the Secure
Rural Schools Act, a way for the government to pay counties that
no longer could depend on revenue from logging in federal forests. But
the law has expired, and the last payments went out in January.
Wyden and other l
 ted was a
nuanced and careful response from Obama and his diplomatic and national
security team. Obama deplored terror, but made clear that the attack was
the result of a cheesy video about the founder of Islam, Mohammed.
"Spontaneous" was the word of the week.As Romney tried to find his
feet on the subject, Republicans began to accuse Obama of laxity. How
could the U.S. not be prepared for an attack on the anniversary
of 9/11? How could the consulate in a city known to be
a home to Islamist radicals be so poorly guarded? What was the
ambassador doing there with such a light security detail? When reporters
made similar, reasonable inquiries, Obama's campaign and administration
dismissed such questions as biased, saying the few members of the press
who pressed the subject were just doing Romney's handiwork. This allowed
Obama to hold the line and prevent greater anxiety or anger in
the electorate. The attack was spontaneous and partly the fault of American
religious radicals, so please stop politicizing this tragedy. But then it
was revealed that there was no riot, spontaneous or otherwise. It had
been a planned, coordinated raid. Further, there had been growing warnings
from the diplomatic team in Libya that trouble was brewing. And while
Obama claimed that Al Qaeda was in tatters, the group seemed to
still be able to strike back.Obama cautioned against rushing to judgment
and said that he and his team's mistakes were no cover up
but r
