Lindows.com ordered to drop Lindows name
Microsoft brought legal action
By Joris Evers, IDG News Service December 11, 2003
Judges in Finland and Sweden have given Microsoft Corp. what it has
twice been denied in the U.S.: preliminary injunctions barring Linux
vendor Lindows.com Inc. from using the Lindows name.
Microsoft sued Lindows.com in the U.S. in December 2001, accusing the
company of infringing its Windows trademark and asking the court to bar
Lindows.com from using the Lindows name. The company lost two requests
for an injunction and the matter is now for a jury to decide in a trial
set to start March 1, 2004.
European courts appear to be siding with Microsoft. The Redmond,
Washington, company sought a preliminary injunction in Finland on Nov.
28 and it was granted on Dec. 1, company spokeswoman Stacy Drake said
Thursday. In Sweden, Microsoft requested a preliminary injunction on
Dec. 9 and got it on Dec. 10, she said.
Microsoft has also filed a request for a preliminary injunction in the
Netherlands and intents to do so in France, where it has already taken
the first step in that process by filing a complaint with a local court,
Drake said.
"In response to what is a clear and obvious infringement on our
trademark, Microsoft has taken action in select international
territories to curtail infringing or misleading behavior on the part of
Lindows.com," Drake said.
Lindows.com spokeswoman Cheryl Schwarzman said the company was unaware
of the Finnish preliminary injunction or the filing of a complaint in
France. Lindows did know of the Microsoft action in the Netherlands, she
said.
Lindows.com Chief Executive Officer Michael Robertson in a statement
issued in response to the Swedish injunction, lashed out against
Microsoft's legal pursuit of his company, accusing Microsoft of using
lawsuits "as a battering ram to smash Linux."
Drake denied that Microsoft is trying to stifle competition.
"Microsoft's steps in this case are only about the Lindows name. We are
merely asking that Lindows.com change its name, which obviously is meant
to copy our Windows brand," she said. "Contrary to Lindows' statements,
this is not about Microsoft trying to prevent competition."

Subject: Question in Indian parliament
Date: Fri, 12 Dec 2003 15:03:03 CST
========== Forwarded message ==========
Below is the text of a question raised in the Indian parliament:
Government of India * Ministry of Communications and Information
Technology * Departemnt of Information Technology * Rajya Sabha unstarred
question No 976 * To be answered on 11-12-2003
Promotion of Free/Libre and Open Source Software
Will the Minister of Comunications & Information Technology be pleased to
state:-
(a) what steps have been taken since the announcement of the Linux India
Initiative by Government on the issue of promoting free/libre and open
source software within the country;
(b) the level of usage of FLOSS products in Government and semi-Government
organisations; and
(c) whether the research benefits of publicly-funded computing
institutions would be made sharable to all, by placing the same under the
General Public Licence (GPL) or similar licences that do not restrict
sharing of knowledge due to copyright restrictions?
ANSWER
Minister of State for Communications and Information Technology (SU
Thirunavukkarasar)
(a): Two more consultative meetings have been held since then for in-depth
discussion on projects and policy positions to be taken -- one with the
Government and associated agencies and another with NGOs/Civil Society.
Various related initiatives, as planned, under Linux India Initiative
exercise are also being pursued.
(b): They are growing.
(c): Research benefits of publicly funded computing institutions are being
shared wherever appropriate. For instance, Centre for Development of
Advanced Computing (C-DAC) had added components relating to a number of
Indian languages for Linux available under General Public Licence (GPL) in
September, 2003. Similarly, open office solutions have been provided for
Indian languages under GPL developed by C-DAC, CollabCAD software
developed by National Informatics Centre (NIC) package has also been put
in a limited sharing mode within certain agencies of Government. C-DAC has
also put its Indian fonts in public domain. Wherever appropriate, software
developed under public funded efforts are being shared under GPL or
similar licenses that do not restrict the sharing of knowledge due to
copyright restrictions ****

Mayastor software converts Linux server into fibre-channel storage system
and unifies NAS, DAS, SAN technologies. The software can be downloaded from
http://www.pavitrasoft.com/downloads/
Mayastor software is a combination of several kernel driver modules that can
convert Linux system into a powerful Fibre Channel storage system. Linux had
proven itself as a powerful NAS system and now it can be a powerful Storage
server too with Mayastor software. The software is very simple to use,
manage and less strain on IT budget. Mayastor software converts standard
Linux server into:
Fibre Channel storage system with RAID/JBOD
NAS system with its block devices appearing as FC LUNs in SAN
Fibre-SCSI protocol gateway to connect legacy SCSI devices to SAN
