That is correct. (IMHO) the boyfriend will probably be convicted.
That however deals with Criminal Law. (ie. sending people to prison)

In civil law however (attempting to get money from people),
 more than one party can be responsible, and a basic premise of
lawsuits today seems to be sue everybody even possibly responsible. And as
was mentioned  here earlier you can go broke defending yourself even if
you are innocent.
