ttyS* and cua* in linux-2.0.20

I just moved from linux-1.2.13 to linux-2.0.20 and find that the serial
drivers have been corrupted. Some time ago, I wrote to Ted T'so about the
serial drivers controversy and he responded that the ttyS* drivers were
POSIX compliant and cua* were not. He went on that since there is a effort
to make linux POSIX and the cua* drivers would eventually be dropped.
Now when I try to call out on a ttyS*, the DTR is very rudely dropped to
interfere with the operation of my call out program.
What sort of land mines have been added to these serial drivers to
subvert the attempt to become fully POSIX?
What can I do to make the ttyS*'s to work like they are supposed to?
