Debatable. You are then shipping a product containing my code against my license
agreement. Furthermore note the GPL is structured very carefully. If its shown
invalid you have NO license to use it at all ..

Phone microsoft up having patched your code into the NT 4.0 kernel layer 
by dint of hacking up their binary. See what they say
