This sealed warrant authorization to commit
burglary seems even more troublesome than the
trend toward dynamic entry.
What would the legal situation be for a
homeowner who defends himself when he sees a
black-masked figure entering his home?
How about for a the black-masked figure if
he returns fire?
At least having black-clad ninjas come crashing
through your windows right after a volly of
concussion grenades is arguably not the typical MO of the criminal element. Can a citizen, at his
legal peril, be held responsible for assessing
whether the large gentleman with the sack is
a LEO or a crook? "If you're going to continue
breaking and entering, I'll have to see some ID

On a lighter note: The conversation when you
call 911 could be amusing when looked upon years
later. How about a black-hat/white hat shootout
if the black-baggers don't bother to tell the
locals what's up?
