I hesitate to think why the grand jury is meeting since the trial date is
set, but two things leap to mind. One, more charges. It's a cute tactic
since the defense will have less time to prepare and it may move for
postponement if new charges are added. On the other hand, the new charges
may be to encourage CJ's attention to force a plea bargain. The downside
for the gov at trial is that it may have to reveal more than it wants to
about how it works and how it can penetrate the electronic medium. Surely
CJ's attorney is focusing on the political/first amendment aspects of this
case. They may not mean much at trial, but they do have import prior to
trial. The other reason for late in the day testimony is that the Grand
Jury is looking at others and the investigation is expanding. This would
not be good news. Proceed cautiously.
