right to terminate User's account and refuse any and all future use of the
Service. User agrees PublicOpinion.com or its designee may disclose data to
third parties about User and information about User's use of the Service
provided that such disclosures do NOT include User's name, mailing address,
email address, telephone or facsimile number ("Personally Identifying
Information"), except as authorized by User or User's representative or as
required by law or legal process.

User will receive a password and account designation upon completing the
registration process. User is responsible for maintaining the
confidentiality of the password and account, and is fully responsible for
all activities which occur under User's password or account. User agrees to
immediately notify the Service of any unauthorized use of User's password
or account or any other breach of security.

User agrees to abide by all applicable local, state, national, and
international laws and regulations in User's use of the Service, and agrees
not to interfere with the use and enjoyment of the Service by other users.
User agrees to be solely responsible for the contents of User's
transmissions through the Service; not to use the Service for illegal
purposes; not to interfere with or disrupt the Service or servers or
networks connected to the Service; to comply with all requirements,
procedures, policies and regulations of networks connected to the Service;
and to comply with all applicable laws regarding the transmission of

abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable
material of any kind. User agrees not to transmit any material that
violates the rights of another, including but not limited to the
intellectual property rights of another. User agrees not to transmit any
material that violates any applicable local, state, national, or
international law or regulation. User agrees not to attempt to gain
unauthorized access to other computer systems or networks connected to the
Service.

User agrees to indemnify and hold PublicOpinion.com, and its parents,
subsidiaries, affiliates, contractors, sub-contractors, partners, owners,
officers, and employees, harmless from any claim or demand, including
reasonable attorneys' fees, made by any third party due to or arising out
of User's use of the Service, User's connection to the Service, User's
violation of the PublicOpinion.com Terms of Service, or User's violation of
any rights of another.

PublicOpinion.com reserves the right to modify or discontinue, temporarily
or permanently, the Service with or without notice to User. User agrees
that PublicOpinion.com shall not be liable to User or any third-party for
any modification or discontinuance of the Service.

PublicOpinion.com is providing User with the capability to send ("Post")
and receive ratings and/or reviews and/or opinions and/or surveys and/or
messages and/or other information via the World Wide Web within the
PublicOpinion.com web site. PublicOpinion.com does not charge User for the
Service, except for Enhancements that User may elect to obtain.

User agrees and affirms that any and all Postings by User are truthful and
based upon the actual experiences of the User; that User has an ongoing
obligation to post any and all new material facts if (and as) new
information becomes available; that all Postings are thus deemed prima
facie to be the truthful opinion of the User who posted them; and that
PublicOpinion.com is acting only as a public forum for Users to express
their opinions and is thus not to be held liable in any way for any of the
Postings of Users of the Service.

PublicOpinion.com will normally not monitor the contents of a User's
communications, except that User agrees PublicOpinion.com may do so as
required by law; to comply with legal process; if necessary to enforce the
POCTOS; to respond to claims that such contents violate the rights of
third-parties; to protect the rights or property of PublicOpinion.com; to
enhance the service; or to edit for clarity or functionality.

User agrees and affirms that PublicOpinion.com reserves the right, but not
the obligation, to edit, delete, and/or refuse to post any materials it, in
its sole discretion, deems detrimental to the Service, and that such action
or lack thereof does not imply nor incur any liability. User acknowledges
and agrees that PublicOpinion.com does not endorse the content of any User
communications and is not responsible or liable for any unlawful,
harassing, libelous, privacy invading, abusive, threatening, harmful,
vulgar, obscene, tortious, or otherwise objectionable content, or content

User again acknowledges and affirms that all Postings by User are User's

PublicOpinion.com a paid up, perpetual, world-wide irrevocable license to
use, copy, and redistribute such materials and information and any portions
thereof and any derivative works therefrom; warrants that User has all the
rights necessary to submit such material or information and that the use of
same by PublicOpinion.com and users of its Service will not infringe upon
any other party's rights, and User hereby provides warranty of
indemnification thereof. By transmitting any communication to the Service,
User grants to PublicOpinion.com a perpetual, worldwide, irrevocable,
unrestricted, exclusive, royalty-free license to use, copy, license,
distribute, display, reproduce, transmit, modify, edit, and otherwise
exploit such communication, in all media now known or later developed. The
foregoing shall include the right to exploit any proprietary rights in such
communications, including, without limitation, any intellectual property
laws under any relevant jurisdiction, and shall constitute a waiver of any
rights, "moral rights," or any similar rights under any jurisdiction.

User acknowledges that any reliance upon any advice, opinion, statement, or
other information displayed or distributed through the Service is at User's
sole risk. PublicOpinion.com reserves the right, but not the obligation, in
its sole discretion, and with or without notice, to correct any errors or
omissions in any portion of the Service, or to deny access to the Service
to anyone at any time. User acknowledges and agrees that PublicOpinion.com
is not responsible for any materials posted by users of the Service and
that PublicOpinion.com shall have no liability arising from purchases of
third party goods or services based upon information provided on the Service.

PublicOpinion.com assumes no responsibility for the deletion or failure to
store User's information. PublicOpinion.com may establish an upper limit on
the size of information storage it will maintain for User. Note that
PublicOpinion.com has no obligation to provide any technical or User support.

User agrees that PublicOpinion.com may terminate User's password, account,
or use of the Service; edit or delete information in User's account and/or
bar any further access to such information, with or without cause, and with
or without notice, at its sole discretion, which includes, but is not
limited to, if PublicOpinion.com believes that User has violated or acted
inconsistently with the letter or spirit of the POCTOS, or that User has
violated the rights of PublicOpinion.com or other Users or parties. User
further agrees that PublicOpinion.com may terminate User's password,
account or use of the Service if User fails to use the Service at least one
time during a reasonable period of time as determined by PublicOpinion.com
from time to time which period shall not be less than three months.

User's correspondence with or participation in promotions of advertisers
found on the Service, including payment and delivery of related goods or
services, and any other terms, conditions, warranties or representations
associated with such dealings, are solely between User and such advertiser.
User agrees not to hold PublicOpinion.com liable for any loss or damage of
any sort incurred as the result of any such dealings or as the result of
the presence of such advertisers on the Service.

The Service may provide and/or Users may include in communications, links
to other Web sites or resources. User acknowledges and agrees that
PublicOpinion.com is not responsible for the availability of such external
sites or resources, and does not endorse and is not responsible or liable
for any content, advertising, products, or other materials on or available
from such sites or resources. User agrees that PublicOpinion.com shall not
be responsible or liable, directly or indirectly, for any damage or loss

Provided that User is in full compliance with the PublicOpinion.com Terms
of Service and is in good standing with PublicOpinion.com, User has a
revocable, non-exclusive, non-transferable, limited right to access, use

and noncommercial use only. Ratings, reviews, reports, opinions, and other
information found on the PublicOpinion.com Service, which includes the name
and trademarks of PublicOpinion.com, may NOT be used in advertising or for

User acknowledges and agrees that both structure and content, including,
but not limited to, text, software, music, sound, photographs, graphics,

and laws. User acknowledges and agrees that User is permitted to use this
material and information only as expressly authorized by PublicOpinion.com

create derivative works of such content or information without express

User agrees that User will not engage in any replication or redistribution
of any part or aspect of PublicOpinion.com for any purposes. This includes,
but is not limited to, the design, structure, function, and appearance of

not to resell the Service or use of or access to the Service. Furthermore,
User agrees not to copy, repurpose, redistribute, or otherwise retransmit

User agrees and acknowledges that User is fully responsible for User's own
acts at PublicOpinion.com, and that if User is injured in any way by any
information or services at PublicOpinion.com it was User's choice alone to
rely on that information or service, and if User is injured by other users

injuries. Accordingly, User agrees not to hold PublicOpinion.com

THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR
RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT
SHORTCOMINGS OR DEFECTS IN THE INFORMATION OR SOFTWARE WILL BE CORRECTED.

USER UNDERSTANDS AND AGREES THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR

USER AGREES THAT PUBLICOPINION.COM SHALL NOT BE LIABLE FOR ANY DIRECT,
INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE

USER FURTHER AGREES THAT PUBLICOPINION.COM SHALL NOT BE LIABLE FOR ANY
DAMAGES ARISING FROM INTERRUPTION, SUSPENSION OR TERMINATION OF SERVICE,
INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL
CONSEQUENTIAL OR EXEMPLARY DAMAGES, WHETHER SUCH INTERRUPTION, SUSPENSION
OR TERMINATION WAS JUSTIFIED OR NOT, NEGLIGENT OR INTENTIONAL, INADVERTENT
OR ADVERTENT.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY
FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS
MAY NOT APPLY TO YOU.

The PublicOpinion.com Terms of Service and the relationship between User
and PublicOpinion.com shall be governed by the laws of the State of Arizona
without regard to any conflict of law provisions. User and
PublicOpinion.com agree to submit to the personal and exclusive
jurisdiction of the courts located within the State of Arizona.

This agreement will be construed as if the parties jointly prepared it, and
any uncertainty or ambiguity will not be interpreted against any one party.
The failure of PublicOpinion.com to exercise or enforce any right or
provision of the PublicOpinion.com Terms of Service shall not constitute a
waiver of such right or provision. If any provision of the
PublicOpinion.com Terms of Service is found by a court of competent
jurisdiction to be invalid, the parties nevertheless agree that the court
should endeavor to give effect to the parties' intentions as reflected in
the provision, and the other provisions of the PublicOpinion.com Terms of
Service remain in full force and effect.
