County Can't Be Sued Over Jail Policy - (LOS ANGELES) -- A county can not
be sued for damages caused by a sheriff's allegedly unconstitutional
policies in managing a jail. That's the ruling from the Second District
Court of Appeal. The case was that of a woman, kept in Los Angeles County
Jail for ten days on a mistaken warrant, which she blamed on the sheriff's
jail management policies. The Appeal court ruled that while sheriffs are
elected by county voters and operate under county budgets, they act as
state officials when carrying-out law enforcement duties, such as running
the jail. So the county can not be held responsible for any civil rights
violation. The attorney for the arrested woman says he will now take the
case to the state Supreme Court.
