u1 firmware and 9.0

While looking for trouble in the central syslogs I noticed that about
5 ultra-1's had logged that their firmware was too old too take the
update.  This would make perfect sense except that most of them were
running 9.0.13, implying that whatever firmware they had could run
9.0.  Is there a reason not to weaken the firmware check to only
machines that aren't yet running 9.0 (might this cause the miniroot
update to explode)?  Should I be shot for bringing up an issue that no
one cares about in the middle of a release cycle?
